commonly known as the SC/ST Act, was enacted to prevent atrocities against
members of the Scheduled Castes (SCs) and Scheduled Tribes (STs). The Act aims

provide relief and rehabilitation to victims.

Short
Title, Extent, and Commencement:
The Act

Definitions:
Atrocity:
Refers to offenses punishable under Section 3 of the Act, committed by

Article 366 of the Constitution of India.
Special
Court: A Court of Session designated to try offenses under this Act.
Offenses
of Atrocities (Section 3):
The Act
specifies various offenses as atrocities when committed against SC/ST
individuals by non-SC/ST individuals, including:
Forcing
an SC/ST member to consume any inedible or obnoxious substance.
Inflicting
harm or indignity, including sexual exploitation.
Wrongfully
occupying or cultivating land owned by SC/ST members.

SC/ST members from accessing public places or using common resources.

any act that degrades or humiliates SC/ST members.
Special
Courts and Exclusive Special Courts (Sections 14 & 14A):
The Act
mandates the establishment of Special Courts for the speedy trial of
offenses under the Act.
Exclusive
Special Courts may be established for regions with a high incidence of
such offenses.
An
appellate mechanism is provided for appeals against judgments, sentences,
or orders, ensuring a time-bound process.
Special
Public Prosecutors (Section 15):
Special
Public Prosecutors are appointed to conduct cases in Special Courts,
ensuring effective prosecution of offenses under the Act.
Rights of
Victims and Witnesses (Chapter IVA):
The Act
ensures protection for victims and witnesses, including:
The
right to be treated with fairness, respect, and dignity.
Protection
against intimidation and harassment.
The
right to information about proceedings and to reasonably participate in
them.
Preventive
Measures (Section 17):
The Act
empowers authorities to take preventive actions, such as:

areas prone to atrocities and adopting measures to ensure the safety of
SC/ST members.
Canceling
arms licenses of persons likely to commit offenses under the Act.
Duty of
the Government (Section 21):
Both
Central and State Governments are required to take necessary measures to
ensure the effective implementation of the Act, including:

surveys to identify offenses under the Act.
Establishing
awareness centers and workshops to educate SC/ST members about their
rights.
Encouraging
non-governmental organizations to assist in implementing the Act.
Relief and
Rehabilitation (Section 15A):
